Terms and Conditions – Public courses

 

Payment & Fees

Payment can be made by cheque, credit card, debit card or BACS Transfer, and must be received 7 working days prior to the commencement of the course. Please quote the reference number from your invoice and organisation name so that payments can be tracked.

Fees are exclusive of VAT or other local taxes. Fees are current at time of publication. Flume Training reserves the right to change the prices at any time, but changes will not affect confirmed registrations.

Please note that you shall be responsible for all costs you incur in connection with your attendance at any Public Courses.

Cancellation

All cancellations must be done in writing and emailed directly to Flume Training. The following charges apply if you cancel:

– 4-30 days before a course = 50% of the course fee
– 1-3 days and No show on the day of the course = 100% of the course fee

If Flume Training cancels or postpones a course, you have the option to transfer to another course or, if you paid for the cancelled/postponed course, receive a full refund of the fees received by Flume Training. Flume Training is not responsible to pay any travel, accommodation costs and/or any other costs incurred by you in respect of the cancelled/postponed course.

Programme Dates & Venues

Flume Training reserves the right to change venues and alter or cancel the published dates without liability.

Liability

To the fullest extent permitted by the applicable law, Flume Training excludes:
(a) all liability for loss, injury or damage to persons or property at the Public Training Course;
(b) all indemnities, warranties, terms and conditions (whether express or implied); and
(c) any actual or alleged indirect loss or consequential loss howsoever arising suffered by you or any loss of profits, anticipated profits, savings, loss of business revenue, loss of business, loss of opportunity, loss of goodwill, or any other type of economic loss (whether direct or indirect). If Flume Training is liable to you for any reason, Flume Training’s total liability to you in relation to the Public Training Course (whether under these terms or conditions or otherwise) is limited to the amount of the registration fees that you paid to Flume Training.

Intellectual Property

All Intellectual Property Rights in the Course Materials and the speeches made by trainers at the Public Courses are, and remain, the intellectual property of Flume Training or its licensors, whether adapted, written for or customised for you or not.
You are not authorised to:-

(i) copy, modify, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit or distribute any of the Course Materials without our prior written permission;
(ii) record on video or audio tape, relay by videophone or other means the Public Course given;
(iii) use the Course Materials in the provision of any other course or training whether given by you or any third party trainer; or
(iv) remove any copyright, trademark or other notice of Flume training on the Course Materials.

In consideration of the Fees paid by you, we grant to you a limited, non-transferable, non-exclusive licence to use the Course Materials for the sole purpose of attending and completing the Public Course.

Money Back Guarantee

We provide a full money back guarantee if you are not satisfied with one of our Public Courses. To reclaim your money all we ask is you have a discussion with one of our directors about why the Public Course did not provide the value you were expecting.

Force Majeure

Focus shall not be in breach of this contract if there is any total or partial failure of performance by it of its duties and obligations under this contract occasioned by any act of God, fire, act of government or state, war, civil commotion, insurrection, embargo, prevention from or hindrance from obtaining any raw materials or energy, sickness or other cause beyond its reasonable control.
If Focus is unable to perform its duties and obligations under this contract as a direct result of one or more such causes Focus shall give written notice to the Client of such inability stating the cause in question.
